GENERAL ONLINE SALES TERMS AND CONDITIONS
1. Seller
These General Terms and Conditions govern purchases made through the website of Villa Dora S.r.l., represented by its pro tempore legal representative, with registered office in Terzigno (NA), Via Bosco Mauro no. 1, VAT/Tax ID 03261281210, certified email (PEC) cantinevilladora@pec.it.
2. Scope of application
These Terms and Conditions govern the distance selling of wines, oil, and other products available in the online catalog.
Making a purchase implies acceptance of these Terms and Conditions in the version available at the time of the order.
The mandatory provisions provided by Legislative Decree 206/2005 (“Consumer Code”) remain unaffected in relations with consumers.
3. Product information
The essential characteristics of each product are indicated in the relevant product sheet.
For food products, Villa Dora makes available, prior to purchase, the mandatory information required by the legislation applicable to distance selling.
Images are for illustrative purposes and may show slight differences compared to the product actually delivered, without prejudice to compliance with the stated essential characteristics.
4. Sale of alcoholic beverages
The sale of alcoholic beverages is reserved exclusively for persons who have reached the age required by Italian law for such purchase.
By placing an order containing wine or other alcoholic beverages, the buyer declares, under their own responsibility, to meet the age requirements set by the regulations.
Villa Dora reserves the right to implement age verification procedures and to not complete the sale or delivery should there be reasonable doubts regarding compliance with the requirement.
5. Purchasing procedure
The customer selects the desired products, adds them to the cart, and proceeds to checkout by entering the requested information.
Before submitting the order, the customer can verify the products, quantities, prices, delivery costs, and total amount, and correct any errors.
Submitting the order via the button clearly indicating the payment obligation entails the assumption of the obligation to pay the price.
6. Conclusion of the contract
The contract is considered concluded according to the procedure indicated on the site and upon the order confirmation sent by Villa Dora to the email address provided by the customer, subject to product availability or lack of payment authorization.
The confirmation summarizes the essential information related to the purchase.
7. Prices
Prices are expressed in euros and include VAT where due, unless otherwise indicated as permitted by law.
Shipping costs and any additional costs are indicated before the final submission of the order.
Villa Dora may change prices at any time, provided that the price displayed and confirmed at the time of purchase applies to the order.
8. Payments
Payment can be made through the systems indicated during checkout.
Electronic payment services may be managed by third parties according to their respective terms and conditions.
Villa Dora does not store payment card details in full when the service is managed directly by the relevant provider.
9. Availability
The ability to add a product to the cart does not absolutely guarantee its availability until the order is completed.
In case of subsequent unavailability, Villa Dora will promptly inform the customer and, where necessary, provide a refund of the sums already paid.
10. Shipping and delivery
Villa Dora makes deliveries in the areas indicated during the purchasing process.
Delivery times and costs are indicated to the customer before the order is sent.
Any delays attributable to the carrier will be managed by Villa Dora in accordance with applicable legislation, without prejudice to the consumer's right to the mandatory protections provided by law.
At the time of delivery, the customer is invited to check the external integrity of the packaging and promptly report any anomalies.
11. Right of withdrawal
Except for exceptions provided by law, the consumer has 14 days to withdraw from the contract without needing to provide a reason.
For sales contracts, the period begins, in accordance with applicable regulations, from the day on which the consumer or a third party designated by the consumer, other than the carrier, acquires physical possession of the goods.
The consumer may communicate the intent to withdraw by means of an explicit declaration sent to Villa Dora's contact addresses.
The consumer must return the goods without undue delay and, in any case, within fourteen days from the notification of the withdrawal, unless otherwise applicable.
Direct costs of the return are borne by the consumer, unless otherwise indicated by Villa Dora.
Villa Dora will issue a refund according to the terms and methods provided by the Consumer Code, and may withhold it in permitted cases until receipt of the goods or until proof of their shipment is provided.
12. Exceptions to the right of withdrawal
The right of withdrawal does not apply in cases provided for by current legislation, including, where concretely applicable, the supply of custom-made or clearly personalized goods, goods liable to deteriorate or expire rapidly, and other cases provided for by Art. 59 of the Consumer Code.
13. Conformity and warranty
The legal guarantee of conformity provided by the Consumer Code applies to consumers.
In the presence of a non-conforming product, the consumer may exercise the remedies recognized by applicable legislation.
14. Complaints
Any complaints may be sent to Villa Dora using the contact details indicated on the site.
Villa Dora undertakes to examine the reports and provide a response within a reasonable time.
15. Liability
Villa Dora is responsible for the exact fulfillment of its obligations according to current legislation.
Any limitation of liability that is incompatible with mandatory provisions for the protection of the consumer is excluded.
16. Data protection
Personal data are processed according to the Privacy Policy available on the site.
17. Applicable law and competent court
The contract is governed by Italian law.
For the consumer, the mandatory territorial jurisdiction of the judge of the place of residence or domicile of the consumer remains unchanged in the cases provided by law.
For relations with subjects who do not qualify as consumers, unless otherwise agreed, the Court of NOLA has exclusive jurisdiction.
